Duke Prosecutor Jailed, Accused Students Seek Settlement

You might remember the famous Duke Lacrosse rape case from March 2006, where three Duke students David Evans, 24; Collin Finnerty, 20 and Reade Seligmann, 21 were accused of sexually assaulting a woman who was hired to perform a strip tease at a lacrosse team party.  

After further investigation, the accuser changed her story in December 2006 after a lack of abili and a lack of forensic evidence. The public prosecutor of that case Michael B. Nifong then drops the rape charges but still persued charges of sexual offense. However, things started going wrong, Mr. Nifong handed the case to the state Attorney General Roy A. Cooper who after an investigation concluded that the accused players were innocent and charged Mr. Nifong as a rogue prosecutor.

The accused who already spent over $3 million on their legal defense are now seeking a settlement of $30 million with the city.  If the city refuses, the students are threatening to file a civil rights lawsuit. Also a suit is being filed against Mr. Nifong who has already reported to jail in Durham, N.C to serve 24 hours for criminal contempt.

Ten Years for Consensual Oral Sex for high school student

Think about this “Ten years, ten years in prison for receiving Oral Sex. That was Genarlow Wilson’s sentence. A Georgia law designed to go after child sex predators has sparked a flood of support for a former honor student serving 10 years in jail.

Picture of Genarlow WilsonWhen Wilson was a high school senior, he was 17 years old and he received consensual oral sex from a 15 year old, 10th grade girl. Everyone agreed, including the prosecutor and the girl herself, that she initiated the act.

It was all captured on video — the evidence used to convict him at trial. On the tape, police saw a 15-year-old perform oral sex on one partygoer, and after finishing with him, she turned and did the same to Wilson. Under Georgia law at the time, this was considered aggravated child molestation, a felony for teens less than three years apart to have oral sex. It carried with it a 10-year sentence, even though it was only a misdemeanor for those same teens to have sexual intercourse.

The D.A. offered Wilson — a football standout who was being recruited by some of nation’s top colleges, including Columbia and Brown — a plea deal: five years in prison and register as a sex offender. He turned it down.

The other students at the party took that deal and some of them are out of prison by now. Because Wilson thought he would be acquitted and did not want to be branded a child molester, he went to trial. The prosecutor blames Wilson for his sentence because none of the other defendants insisted on a trial; all the others “took their medicine.”

Wilson knew the risks, rolled the dice by going to trial and lost. This happened 2 years ago.
After Wilson’s conviction and sentence, the legislature changed the statute realizing it was unfair. It now makes consensual oral sex between teens a misdemeanor. Too little, too late for Wilson, as the law does not apply retroactively. The legislature could change the law again, and there is presently a bipartisan bill that has been introduced to do just that.

in the search bar and replace AskStudent with your favorite band, and you will only find open indexes that contain downloadable music files.

For example, my favorite band is Linkin Park. So, I go to Google and type this, in the search bar

At times like this, when no one is looking, I hug my computer. This whole Internet thing is pretty cool. 

AskStudent Advisory: Please check the local laws in your country. At a lot of places, downloading music is illegal. Subscribe to music. It’s hella cheaper than buying, just as entertaining, and not near as time consuming or worrisome. Also, your favorite bands get something in their pocket… which helps them make the next CD and you contribute, as opposed to consuming.

The Virginia Tech Massacre of 04.16.2007

They came to Blacksburg, Va., from all over the country — and all over the world. They came to study and they came to teach. They had plans. They had friends. They had families.

As the list of confirmed victims in Monday’s massacre on the Virginia Tech campus grew, so too did the number of stories about the individuals who fell victim to the gunman, 23 year-old Cho Seung-Hui of Centreville, Va.

1. Ross Abdallah Alameddine, 20, of Saugus, Mass. He was a sophomore English major who was gunned down in French class.

2. Ryan Clark, 22, from Martinez, Ga., a biology, English and psychology major. He was a resident adviser on the fourth floor of the dorm where the rampage began.

3. Daniel Perez Cueva, 21, a student from Peru who was studying international relations. He was shot during French class, according to his mother, Betty Cueva.

4. Caitlin Hammaren, 19, of Westtown, N.Y., was a sophomore majoring in international studies and French, according to officials at her former school district.

5. Emily Jane Hilscher, 19, from Woodville, Va., according to family friend John McCarthy. She was a freshman majoring in animal and poultry sciences.

6. Matt La Porte, age unknown, from Dumont, N.J., a freshman majoring in university studies.

7. Jarrett Lane, 22 , from Narrows, Va., a senior majoring in civil engineering.

8. Henry Lee, age unknown, from Roanoke, Va., a freshman majoring in computer engineering.

9. Juan Ortiz, 26, a graduate student in civil engineering from Puerto Rico

10. Mary Karen Read, 19, of Annandale, Va., according to her aunt, Karen Kuppinger, of Rochester, N.Y.

11. Reema Samaha, 18, from Centreville, Va., a freshman whose passion was dance.

12. Leslie Sherman, age 20, a sophomore majoring in history and international studies.

13. Maxine Turner, age unknown, from Vienna, Va., a senior majoring in chemical engineering.

14. Erin Peterson , Centreville, Virginia. Age unknown, graduated in 2006 from Westfield High School in Chantilly, Va., along with a second victim, Reema Samatha. That is the same high school that the alleged gunman, Cho Seung-Hui, graduated from three years earlier

15. Jeremy Herbstritt, 27, of Johnstown, Penn., according to WJAC TV. A graduate student in engineering, he had received his bachelor’s degree from Penn State

16. Daniel O’Neil, 22, of Lincoln, R.I. A graduate student in environmental engineering, he received a bachelor’s degree in civil engineering from Lafayette College last year

17. Brian Bluhm, 25, from Cedar Rapids, Iowa, a civil engineering graduate student.

18. Michael Pohle, 23, of Flemington, N.J., graduated from Hunterdon Central High, according to school officials.

19. Austin Cloyd, age unknown, born in Charlotte, N.C was a freshman majoring in international studies and French.
